3. Eligibility

4. Account Registration

Creating an Account

• You must provide accurate, current, and complete information
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized access

5. Subscription and Payment

Subscription Plans

• Memory Plan: $29/month - Basic legacy storage and features
• Forever Plan: $99/month - Advanced AI evolution and unlimited features

Billing

• Subscriptions are billed monthly in advance
• Payments are processed securely through Stripe
• You authorize us to charge your payment method for recurring subscription fees
• Prices are subject to change with 30 days' notice

Cancellation and Refunds

• You may cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• No refunds for partial months or unused features
• Upon cancellation, your data is retained for 90 days, then permanently deleted unless you reactivate

6. User Content and Data

Your Content

You retain all rights to content you upload ("User Content"), including voice recordings, photos, videos, timeline events, scheduled messages, and profile information.

Content Restrictions

You agree NOT to upload content that:

• Violates laws or regulations
• Infringes intellectual property rights
• Contains malware or harmful code
• Is defamatory, obscene, or hateful
• Impersonates another person
• Contains private information of others without consent
• Promotes violence or illegal activities

7. AI and Voice Cloning

AI Training

• Your voice recordings and text are used to train a personalized AI model
• AI models are isolated to your account and not shared with other users
• AI-generated responses are based solely on your provided data
• We do not guarantee 100% accuracy of AI representations

Voice Cloning Ethics

• You represent that you have the right to clone your own voice
• You agree not to use voice cloning to impersonate others
• You understand that AI-generated voice may not perfectly replicate your actual voice
• You are responsible for how your AI Legacy is used by family members you authorize

8. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STAYWITHUS.AI SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
